Welcome to ShirtBoom. These Terms of Service ("Terms") govern your access to and use of shirtboom.com (the "Site") and any products or services we offer ("Services"). By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

ShirtBoom designs and sells themed Hawaiian shirts for holidays, hobbies, and everyday moments. Throughout these Terms, "ShirtBoom," "we," "us," and "our" refer to ShirtBoom and any affiliates. Contact us anytime at hello@shirtboom.com.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order or create an account. By using the Site, you represent that you meet this requirement and that the information you provide is accurate.

3. Accounts

You may browse the Site without an account, but some features (order history, saved addresses, faster checkout) require one. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorized access.

4. Products and Pricing

We do our best to display accurate product images, descriptions, and prices, but we do not warrant that descriptions or other content are error-free. Colors may appear different on different screens. Pricing, availability, and promotions may change at any time without notice. If we identify a pricing error after you place an order, we may cancel the order and refund you in full.

5. Orders and Payment

Submitting an order is an offer to purchase. We may accept, decline, or limit any order — for example, if a product is out of stock, if we suspect fraud, or if shipping to your location isn't supported. Your order is confirmed once we send a confirmation email. Payment is charged at the time the order is placed and is processed by our third-party payment providers.

6. Shipping and Risk of Loss

Shipping is governed by our Shipping Policy. Title and risk of loss pass to you upon delivery to the carrier. International customers are responsible for any duties, taxes, and customs fees imposed by their country.

7. Returns and Refunds

Returns are governed by our Refund Policy. Please read it carefully — it contains time limits, condition requirements, and restocking rules.

8. Promotions, Discounts, and Gift Cards

Promotional codes are subject to specific conditions stated at the time of issue. Codes may not be combined unless explicitly stated. Gift cards are non-refundable, do not expire, and may not be redeemed for cash except where required by law.

9. Intellectual Property

All content on the Site — including prints, designs, photography, copy, logos, and the ShirtBoom name — is owned by ShirtBoom or our licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, modify, distribute, or commercially exploit any of it without our prior written permission. Personal, non-commercial browsing is permitted.

10. User-Submitted Content

If you submit photos, reviews, or comments (whether via the Site, email, or social media using one of our hashtags), you grant ShirtBoom a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, and display that content for marketing purposes, with attribution where reasonable. You represent that you own the rights to the content you submit.

11. Acceptable Use

You agree not to use the Site to: violate any law; infringe on the rights of others; transmit viruses or harmful code; scrape, harvest, or otherwise extract data via automated means; impersonate any person or entity; or interfere with the operation of the Site.

12. Third-Party Services

The Site uses third-party services (such as Shopify for hosting and payment processing, shipping carriers, analytics, and email tools). Your use of those services is subject to their own terms.

13. Disclaimers

The Site and products are provided "as is" and "as available." To the maximum extent permitted by law, ShirtBoom disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or virus-free.

14. Limitation of Liability

To the maximum extent permitted by law, ShirtBoom and its officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or products — including loss of profits, data, or goodwill — even if advised of the possibility of such damages. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

15. Indemnification

You agree to indemnify and hold ShirtBoom harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your infringement of any third-party rights.

16. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms. Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

18. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms. For material changes, we may also notify you by email if you have an account.
